Why provide training?
California law AB 1825, requires companies with 50 or more employees in California (which includes F/T & P/T employees and contractors) to provide training on the prevention of sexual harassment, discrimination, and retaliation to all supervisory employees.

In other states, though not required by statute, a regular training program provides employers with an affirmative defense in case of threatened litigation. In addition, providing training enhances employee relations by instilling a feeling that the Company takes discrimination issues seriously.


Who is considered a supervisor?
Anyone in the company who has authority (significant influence) over others meets the criteria as a supervisor per AB 1825 guidelines. It generally includes anyone having the means to: hire, transfer, suspend, lay-off, fire, promote, assign, reward, or discipline other employees. If you are responsible for one or more of these areas, you would still be considered a supervisory role by the state of California, even if you may not have a supervisory title.


What about non-supervisory trainings?
Providing non-supervisory training provides a multitude of benefits to employers. First, it reinforces the Company’s anti-discrimination policies and grievance procedures. Second, it reminds employees how to maintain a respectful workplace. Third, it provides employers with a stronger defense in case of threatened litigation.

How long is the training and how much is it?
Supervisory training is a minimum of two hours, exceeding the requirements under California law. How often should we provide training?
Under AB 1825, supervisory training must occur within six months of hiring or assumption of the supervisory role. Accordingly, we recommend scheduling supervisory training sessions every six months. Non-supervisory training should be conducted yearly.
